These Terms & Conditions (“Terms”) govern your access to and use of the Kura Solution website, resident and facility portals, online forms, and messaging (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 18 years old to use the Services. Access to the staff, facility, and resident portals is provided to authorized users only. You are responsible for the accuracy of the information you provide and for activity that occurs under your account.
2. Authentication (one-time passcodes)
We use one-time passcodes (sent by email or SMS) instead of passwords. You agree to keep your contact details current and your access to your email/phone secure. Do not share passcodes; we will never ask you for a passcode outside the sign-in flow.
3. SMS / text messaging terms
By providing your mobile number you agree to receive transactional SMS messages from Kura Solution related to account authentication (one-time passcodes) and service notifications (referral, application, and submission status).
- Message frequency varies with your activity.
- Message and data rates may apply.
- Reply STOP to unsubscribe at any time; reply HELP for help, or contact support@kurasolution.org / [Phone Placeholder].
- Carriers are not liable for delayed or undelivered messages.
- Consent to texts is not a condition of receiving services. Our handling of mobile data is described in our Privacy Policy.
4. Electronic signatures and records
You consent to use electronic records and signatures. Drawn or typed signatures captured through the Services are intended to be legally binding under the U.S. E-SIGN Act and the Uniform Electronic Transactions Act (UETA). We retain an audit trail (IP address, device, timestamp, and a signature fingerprint) as the evidentiary record. You may request a paper copy of any document you signed.
5. Acceptable use
- Provide truthful, accurate information.
- Do not access accounts or records that are not yours, or attempt to bypass security.
- Do not submit unlawful, harmful, or infringing content, or disrupt the Services.
- Use the Services only for their intended purpose.
6. Confidentiality
Information handled through the Services may include records protected under 42 CFR Part 2 and HIPAA. You agree to access and use such information only as authorized and to maintain its confidentiality.
7. Intellectual property
The Services, including text, graphics, logos, and software, are owned by Kura Solution or its licensors and are protected by law. You may not copy, modify, or distribute them except as expressly permitted.
8. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. The Services do not provide medical advice and are not a substitute for professional care or emergency services.
9. Limitation of liability
To the fullest extent permitted by law, Kura Solution and its officers, employees, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Services.
10. Indemnification
You agree to indemnify and hold harmless Kura Solution from claims, damages, and expenses arising out of your misuse of the Services or violation of these Terms.
11. Termination
We may suspend or terminate access to the Services at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of [State], without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in that state.
